Vivonu takes reasonable steps to provide accurate information concerning products offered through our online store.

Product pages may include information such as:

  • Product descriptions

  • Dimensions

  • Ingredients

  • Specifications

  • Features

  • Usage information

  • Compatibility information

  • Colours

  • Sizes

  • Variants

  • Pricing

  • Safety or usage instructions

Actual products may occasionally differ slightly from website images because of matters such as:

  • Lighting

  • Screen settings

  • Packaging updates

  • Manufacturer updates

  • Product improvements

  • Minor production variations

Where a difference is material, the matter will be handled in accordance with applicable consumer law.

Vivonu does not intentionally misrepresent the nature, characteristics, quality, benefits, availability or features of products offered for sale.

5. Product Availability

All products are subject to availability.

Adding a product to your shopping cart does not necessarily reserve the product.

Stock availability may change between:

  • Adding an item to your cart

  • Proceeding to checkout

  • Submitting payment

  • Payment authorisation

  • Processing the order

If Vivonu is unable to fulfil an accepted order because a product is unavailable, we will notify you and provide an appropriate remedy.

Depending on the circumstances, this may include:

  • Cancellation of the affected item

  • Cancellation of the order

  • An agreed alternative

  • A refund

Refunds for unavailable products will be handled in accordance with applicable law.

6. Prices and Currency

Unless clearly stated otherwise, prices displayed on vivonu.co.za are in South African Rand (ZAR).

Prices may change from time to time.

The price applicable to an order will generally be the price displayed during checkout when the order is submitted, subject to applicable law and genuine technical, system or typographical errors.

Where applicable, delivery charges, taxes and other fees will be disclosed during the purchasing process.

Vivonu will not intentionally impose undisclosed charges.

7. Taxes

Any tax that Vivonu is legally required to collect will be calculated or disclosed as required by applicable law.

The tax treatment applicable to purchases may change if Vivonu's tax obligations or registration status changes.

Nothing in these Terms should be interpreted as representing that a particular tax is included or charged unless this is reflected on the applicable product page, checkout, order confirmation, invoice or other transaction document.

8. Pricing and Technical Errors

Despite reasonable efforts, a product or service may occasionally display incorrect pricing, availability or other material information because of:

  • Typographical errors

  • Data-feed errors

  • System faults

  • Technical problems

  • Incorrect promotional configuration

  • Obvious display errors

  • Integration errors

Where a genuine material error is discovered before an order has been finally accepted or fulfilled, Vivonu may contact you and:

  • Ask whether you wish to proceed using the corrected information; or

  • Cancel the affected item or order where legally permitted.

If Vivonu cancels a paid order, any amount due for refund will be refunded appropriately.

Nothing in this section permits Vivonu to disregard consumer rights acquired under applicable law.

9. Promotions and Discounts

Vivonu may offer:

  • Promotional codes

  • Percentage discounts

  • Sale pricing

  • Bundles

  • Limited-time offers

  • Promotional gifts

  • Free or discounted delivery

  • Other special offers

Specific promotional terms may apply.

Unless otherwise stated:

  • Promotions are subject to availability

  • Discount codes have no cash value

  • Promotions may apply only to selected products

  • Promotions may have start and end dates

  • Discounts may not always be combined

  • Eligibility requirements may apply

  • Promotional stock may be limited

Where specific promotional terms are displayed with an offer, those terms form part of the applicable promotion.

Vivonu may amend or withdraw promotions where legally permissible, provided existing consumer rights are respected.

10. Placing an Order

Before submitting an order, customers should carefully review:

  • Products selected

  • Product variants

  • Quantities

  • Prices

  • Discounts

  • Delivery details

  • Contact information

  • Payment information

  • Shipping method

  • Delivery charges

  • Order total

Our checkout process is designed to provide customers with an opportunity to review and correct relevant information before finally placing an order.

Customers are responsible for checking the accuracy of their order information before submission.

11. Order Confirmation and Acceptance

When you submit an order, you are requesting to purchase the selected products.

You may receive an automated order-confirmation email or other message confirming that Vivonu has received your order.

An automated acknowledgement does not necessarily mean that an order has been finally accepted where additional payment, fraud, availability or fulfilment verification is reasonably required.

Subject to applicable law, an order may be declined, placed on hold or cancelled for legitimate reasons including:

  • Product unavailability

  • Payment failure

  • Suspected fraud

  • Unauthorised payment use

  • Material product-information errors

  • Genuine technical or pricing errors

  • Delivery restrictions

  • Legal or regulatory restrictions

  • Inability to fulfil the transaction

Where Vivonu cancels a paid order, amounts due will be refunded in accordance with applicable law.

12. Payment

Orders must be paid using payment methods made available during checkout.

Available payment methods may include third-party payment providers such as Yoco, PayPal, or other payment services made available by Vivonu from time to time.

By submitting payment information, you confirm that you are authorised to use the selected payment method.

Payments may be processed by authorised third-party payment service providers.

Where payment processing is handled directly by an external payment provider, Vivonu does not intentionally store complete payment-card numbers, CVV codes or complete payment-card credentials on its own systems.

Payment providers may apply their own:

  • Security procedures

  • Privacy policies

  • Fraud-prevention procedures

  • Verification processes

  • Terms and conditions

Payment must be successfully authorised or confirmed before an order can be processed where applicable.

13. Payment Authorisation and Failed Payments

An order may not proceed where payment:

  • Is declined

  • Cannot be authorised

  • Is reversed

  • Fails security verification

  • Is flagged for suspected fraud

  • Is otherwise not successfully completed

Vivonu is not responsible for a payment provider or financial institution declining a transaction where that decision is made independently by the provider.

Customers may need to contact their bank or payment provider where a transaction is declined.

14. Fraud Prevention and Verification

To protect customers and Vivonu, orders may be subject to reasonable fraud-prevention, payment-verification or security procedures.

Vivonu or its payment providers may request additional verification where circumstances reasonably suggest:

  • Unauthorised payment use

  • Identity misuse

  • Fraudulent transactions

  • Suspicious purchasing activity

  • Unusual payment activity

  • Account compromise

An order may be placed on hold or cancelled where we reasonably believe completing the transaction could expose the customer, Vivonu or another person to fraud or unlawful activity.

Personal information processed for fraud-prevention purposes will be handled in accordance with our Privacy Policy and applicable law.

15. Shipping and Delivery

Vivonu will make reasonable efforts to dispatch and deliver orders according to the delivery information communicated during checkout and our Shipping Policy.

Delivery timeframes may be affected by circumstances including:

  • Courier delays

  • Public holidays

  • Severe weather

  • Incorrect delivery information

  • Remote delivery locations

  • Product availability

  • Warehouse operations

  • Supplier fulfilment

  • Transport interruptions

  • Customs or border procedures for international orders

  • Events outside our reasonable control

Delivery estimates are estimates unless expressly stated otherwise.

Customers are responsible for providing accurate and complete delivery information.

Products remain subject to applicable statutory rules concerning delivery and risk.

For current domestic shipping rates, free-delivery thresholds, estimated delivery times and further conditions, please refer to our Shipping Policy and the shipping options displayed during checkout.

16. Delayed or Unavailable Orders

Where an order cannot be delivered within the agreed or legally applicable timeframe, Vivonu will handle the matter in accordance with applicable law.

Where products become unavailable after an order is placed, Vivonu may:

  • Notify you

  • Offer an alternative where you agree

  • Cancel the affected product

  • Cancel the affected order

  • Provide a refund where required

Vivonu will not substitute a materially different product without your agreement.

17. Returns, Refunds, Replacements and Statutory Remedies

Returns, refunds, replacements, repairs and other remedies are governed by our Returns & Refund Policy and applicable South African law.

Vivonu's voluntary change-of-mind return period does not replace statutory consumer rights.

Vivonu does not generally offer change-of-mind exchanges unless expressly approved.

Depending on the circumstances, consumers may have statutory rights relating to:

  • Defective goods

  • Unsafe goods

  • Incorrect products

  • Misdescribed products

  • Damaged goods

  • Qualifying electronic transactions

  • Statutory cooling-off rights

  • Failed or delayed performance

Where applicable law permits or requires repair, replacement, refund or another remedy, Vivonu will provide the applicable remedy in accordance with those legal requirements.

Where applicable law gives the consumer the right to choose the remedy, Vivonu will respect that statutory right.

Please review our Returns & Refund Policy for further information.

18. Order Cancellations

If you wish to cancel an order before dispatch, contact Vivonu as soon as possible at:

support@vivonu.co.za

Vivonu will attempt to cancel an order that has not yet entered fulfilment or dispatch.

Cancellation cannot always be guaranteed once an order has been packed, fulfilled, dispatched or entered the courier network.

Where a statutory cancellation or cooling-off right applies, that right will be handled according to applicable law and our Returns & Refund Policy.

19. Wellness, Supplements and Health-Related Products

Vivonu may sell wellness, nutritional, supplement, fitness, personal-care and related products.

Information provided through the website concerning these products is intended as general product information and is not intended to substitute for professional medical advice, diagnosis or treatment.

Customers should:

  • Read product labels carefully

  • Review ingredients before use

  • Follow usage instructions

  • Follow recommended serving or usage directions

  • Review warnings and contraindications

You should consider consulting an appropriately qualified healthcare professional before using supplements where appropriate, particularly if you:

  • Are pregnant or breastfeeding

  • Have a medical condition

  • Are taking prescription medication

  • Are receiving medical treatment

  • Have known allergies

  • Have concerns about whether a product is suitable for you

Individual experiences with wellness and nutritional products may vary.

Vivonu does not guarantee that a wellness, supplement or nutritional product will produce a particular health, medical, fitness or lifestyle outcome.

Nothing in this section excludes any legal responsibility relating to:

  • Product safety

  • Product quality

  • Accurate product information

  • Lawful advertising

  • Mandatory consumer rights

20. Electronics, Baby Products, Fitness Equipment and Other Goods

Customers should follow applicable:

  • Manufacturer instructions

  • Assembly instructions

  • Safety warnings

  • Usage recommendations

  • Maintenance requirements

Where professional installation or assembly is reasonably required, customers should use an appropriately qualified person.

Damage caused after delivery by misuse, abuse, unauthorised alteration, improper installation or use contrary to applicable instructions may not qualify as a product defect, subject to applicable law.

Nothing in this section excludes statutory rights relating to genuinely defective, unsafe or incorrectly supplied goods.

21. Product Warranties

Certain products may include:

  • Manufacturer warranties

  • Supplier warranties

  • Vivonu warranties

  • Statutory warranties

Any express warranty is additional to mandatory statutory rights where applicable.

Warranty exclusions relating to misuse, abuse, accidental damage, improper installation or unauthorised alteration apply only to the extent permitted by law.

Where applicable legislation gives customers rights relating to defective, unsafe or poor-quality goods, those statutory rights remain available regardless of any additional manufacturer's warranty.

22. Intellectual Property

Any dispute will be dealt with through courts, tribunals, regulators, ombuds or other dispute-resolution procedures having lawful jurisdiction over the matter.
